After the decease of my wife I give and bequeth to William Fletcher, son of James Fletcher Jr the above mentioned tracts; John Fletcher, Senr, son of Thomas to receive 150 acres of land on the brushy (?)     • ** 1 Mar 1806 - Order to the Sheriff of Wilkes Co. - You are hereby commanded to the take the bodys of Susanah Fletcher, Executrix and John Fletcher Executor of James Fletcher dec'd, if to be found in your county and then safely keep so you have them before the judges of the Superior Court of Law for the District of Morgan athe courthouse in Morganton on the 4th day of Sept next; then and there to answer John Cox in a plea (?) of convenant to his damage of 150 (?) pounds.
      ** September 1807 - John Cox vs Jas Fletcher, Exr - John Fletcher one of the executors of James Fletcher, dec'd makes oath that upon the return of this suite to Morgan Superior Court he employed D. (?) Cameron (?) Esqr Atty at Law to appear and defend the said suit in behalf of said Jas Fletchers executors. That in March last he attended at Morganton, the time that the Superior Court usually set at that place; that finding said suit had been removed to this county he attempted to come to this court, but from the badness of the weather and high waters could not get here until court had adjourned; by which time judgement by default had been entered in said suit. He prays to have it set aside as he thinks he has a good cause of defense. - Signed John Fletcher
